A. As the policymaking body of the Osage Veterans Memorial, the Commission shall be charged with the oversight and control of the Osage Veterans Memorial. The formulation and adoption of written policies shall constitute the basic method by which the Commission exercises this leadership in the operation of the Osage Veterans Memorial.

B. Without limiting the powers granted to the Commission by the Osage Nation Congress and subject to lawful and applicable rules and regulations, Commission responsibilities are as follows:

1. Appoint or terminate the director of the Osage Veterans Memorial;

2. Adopt and periodically review a statement of philosophy, mission, and goals, which clarifies basic educational responsibilities of the Osage Veterans Memorial;

3. Establish broad general policies for the governance of the Osage Veterans Memorial and hold the director accountable for administering them;

4. Develop an annual budget to finance the operation of the Osage Veterans Memorial for presentation to the Osage Nation Congress by June 15th of each year;

5. Direct the architectural design selection process for the Osage Veterans Memorial, which shall be an open competition and nationally advertised, and to make a final selection for the architect;

6. Review and approve all construction contracts and approve all expenses on construction contracts in accordance with the bidding process law of the Osage Nation;

7. Provide required personnel and physical facilities, with financial support, to carry out the goals and objectives of the Osage Veterans Memorial;

8. Review and make recommendations to the Osage Nation Congress on matters relating to site selection;

9. Consider communications and requests from Osage citizens on matters of policy, administration and other items of public concern affecting the Osage Veterans Memorial;

10. Engage in fundraising for the Osage Veterans Memorial and inform the public concerning the progress and needs of the Osage Veterans Memorial, the financial status of the Osage Veterans Memorial, and accurately account to the Osage Nation Congress, Principal Chief, and Treasurer of the Osage Nation for receipts and expenditures;

11. Perform such other duties as may be prescribed by law and act directly in matters not covered by specific law or policy;

12. Perform an annual evaluation of the performance of the director;

13. Use the tax-exempt status of the Osage Nation for purposes of the Osage Veterans Memorial; and

14. Enter into necessary contracts or business agreements as required to fulfill the duties of the Commission and objectives of the Osage Veterans Memorial. However, the Commission has no power or right to authorize a waiver of sovereign immunity without consent by resolution from the Osage Nation Congress. ONCA 11-86, eff.
